In any personal injury claim, three requirements have to be met in order to have a monetary recovery:

There must be an injury.

Another party must be at fault, or partially at fault, for the incident that caused the injury.

The party responsible for the injury must have a source of funds (insurance or otherwise) from which to compensate the injured party.

If any of the above requirements are missing, there can be no monetary recovery for any injury sustained.

An injured party is entitled to be compensated for the following:

1. Medical bills to date, and into the future, resulting from injuries sustained in the incident.
2. Loss of wages or income to date, and into the future, as a result of the incident.
3. Intangible aspects of any injury sustained such as pain, discomfort, suffering, anxiety, frustration, mental and emotional stress and strain, loss of enjoyment of life, change of lifestyle, and so forth.

The amount recovered depends upon the nature, extent and duration of the injuries.

Injured parties are also entitled to be compensated for property damage sustained as a result of an incident. Examples of property damage would include repair or replacement of a motor vehicle; damage to personal items such as clothing, eye glasses or tools; automobile rental expense; and so forth.
